Terms of Service

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older. We do not knowingly provide the Service to anyone under 18.

2. Description of Service

Invisibl is a Mac desktop application that captures screenshots of your screen and sends them to third-party AI services (including Anthropic and OpenAI) to generate real-time responses. The Service is intended for personal productivity use during meetings and presentations.

3. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate and complete information when registering
• Keep your login credentials confidential
• Notify us immediately at support@invisibl.app if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Billing

Free Trial: New accounts receive a limited free trial. After the trial, continued use requires a paid subscription.

Monthly Subscription: Billed at $29 per month. Includes 150 credits per billing period. Unused monthly credits do not roll over to the next billing period.

Additional Credits: May be purchased separately. Purchased credits do not expire and carry over indefinitely, provided your subscription remains active. Purchased credits may not be used without an active paid subscription.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.

Payment Processing: Payments are processed by Stripe. By providing payment information, you agree to Stripe's terms of service. We do not store your payment card information.

We reserve the right to modify pricing with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Cheat, deceive, or defraud any person or organization
• Circumvent security measures of any system
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or commercialize access to the Service
• Use the Service in any way that could harm, disable, or impair it
• Attempt to access another user's account

We reserve the right to terminate your account if we determine, at our sole discretion, that you have violated these Terms or are abusing the Service.

6. Screen Capture and AI Processing

When you use the Service, screenshots of your screen are captured and transmitted to third-party AI providers (Anthropic and/or OpenAI) for processing. By using the Service, you acknowledge and agree that:

• Screenshots are transmitted to third-party AI providers for the sole purpose of generating responses
• Screenshots are not stored on our servers
• You are responsible for ensuring that any content captured by the Service does not violate the rights of others or any applicable law
• You will not use the Service to capture confidential, classified, or legally privileged information unless you have authorization to do so
• AI-generated responses may be inaccurate and should not be relied upon for legal, medical, financial, or other professional advice

Use of third-party AI services is subject to the terms and privacy policies of those providers.

7. Intellectual Property

The Service, including its software, design, and content, is owned by Invisibl, LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

You retain ownership of any content you create using the Service. By using the Service, you grant us a limited license to process your content solely to provide the Service to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AI-GENERATED RESPONSES ARE NOT GUARANTEED TO BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INVISIBL, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Invisibl, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
